Acceptable Use Policy

The Acceptable Use Policy is a set of rules that places restrictions on the ways in which our website, network and systems may be used, and sets out guidelines on how to use them properly.

This “Acceptable Use Policy”, abbreviated as the “AUP”, issued by Illevante Cloud LLC, applies to all services provided to the customer by Illevante Cloud LLC and all its other divisions and identities. Subsequent references to the name Illevante Cloud LLC are to be taken as including all the entities mentioned above. This policy is designed to provide a clear understanding of the rules, regulations and restrictions on the use of the services, servers and IP addresses of Illevante Cloud LLC.

Illevante Cloud LLC may, from time to time and at its sole discretion, impose rules, regulations or restrictions not expressly set out in this policy with regard to the use of its services, servers and IP addresses. The company may also, from time to time and at its sole discretion, amend this policy, and such amendments become effective as soon as the amended version is posted on the website (www.illevante.com) or the customer is notified of them. Please note that this policy is not exclusive or exhaustive of all cases.

Illevante Cloud LLC is sometimes required by law to provide customer information to law enforcement officials, upon presentation of a valid legal subpoena issued by a court of appropriate jurisdiction. The requested information is disclosed as directed by the subpoena. Illevante Cloud LLC takes great care to maintain the security and privacy of its customers’ information, and will disclose only the information specifically described in the subpoena. Illevante Cloud LLC will also notify the customer of this request for information if permitted to do so under the subpoena.

Illevante Cloud LLC receives reports of alleged violations of the Acceptable Use Policy exclusively through the abuse report page on our website (illevante.com/abuse-report) or at abuse@illevante.com. Illevante will review the information provided and take appropriate action based on it.

The following violations are considered breaches of our general terms and our Acceptable Use Policy, and will result in the suspension or cancellation of services. Any fees paid in advance before the date of such suspension or cancellation are non-refundable.

A violation of the “CAN-SPAM” Act of 2003, or of any other applicable law regulating email services, is a violation of this Acceptable Use Policy (AUP). Service will be cut off for any customer who hosts websites or provides services on their server that support spammers, or that cause any of the IP addresses of Illevante Cloud LLC to be listed in any of the various spam databases such as “SpamHaus” or in black hole lists.

The customer is given a 24-hour warning period to allow them to correct the violation before the suspension of service takes effect. If the listing database charges a fee for removal from the list (de-listing fee), the costs will be charged to the responsible customer, starting from a flat fee of $100.

Using the services of Illevante Cloud LLC for unlawful purposes or in support of unlawful activities is prohibited, including, without limitation, transmitting, distributing, downloading, copying, caching, hosting or storing data, information or content that, in the sole discretion of Illevante Cloud LLC, constitutes a violation of any relevant law, regulation, decree or court order. The customer is solely responsible for determining which laws, regulations, decrees and court orders apply to their use of the services of Illevante Cloud LLC.

Using the services of Illevante Cloud LLC to transmit or store on the server any material that is abusive, threatening or encourages bodily harm, destruction of property or any other kind of harm, or any material that breaches any duty under any law (including court orders), contract or any legal fiduciary relationship, is prohibited.

Adding, removing, modifying or forging any message header, network header or packet header (TCP/IP packet header), or any part of any header or information in any transmission originating from or passing through the services of Illevante Cloud LLC, with the intent to deceive or mislead, is prohibited. Impersonating any person or entity, or attempting to do so, in any communication originating from or passing through our services is also prohibited. This includes misleading or attempting to mislead any person or entity by using incorrect identifying information.

Using the services of Illevante Cloud LLC to promote or engage in any fraudulent activity or for any fraudulent purpose, to make any fake offers to sell or buy products, goods or services, or to promote any kind of financial fraud, including, without limitation, pyramid schemes, chain letters or any other financial scams, is prohibited. Using the services of Illevante Cloud LLC to create any deception, or to make misleading or false statements or writings or carry out misleading or false activities, is also prohibited.

Interfering with, disrupting or adversely affecting the ability to use the services of Illevante Cloud LLC, the internet or any other services or equipment, or attempting to do so, is prohibited (this includes “Denial-of-Service” attacks against another network, host or individual user). Using our services to interfere with, disrupt or adversely affect the services of any customer, its users, or any host, network or system is also prohibited, including, without limitation, by overloading, flooding, email bombing, news bombing, crashing systems or any similar activity. Using the services of Illevante Cloud LLC to obstruct another person’s use of email or news services, or using any program or sending messages of any kind designed to interfere with or disrupt a user’s session, is also prohibited.

Accessing, damaging or seizing any data, information or accounts belonging to others, or attempting to do so, is prohibited. Logging in to a server or account, or entering or using a computer system belonging to another person or entity (or attempting to do so), where the customer or its user is not authorized to access, enter or use it, is also prohibited. Breaching or attempting to breach the security measures of Illevante Cloud LLC, the software or hardware of another person or entity, electronic communications systems, or telecommunications systems or their security, and any similar activity prohibited by law, is also prohibited.

Using the services of Illevante Cloud LLC to transmit or store on the server any information, data, content, material or works that infringe the copyright, trademarks, service marks, patents, trade secrets or any other intellectual property rights of any person or entity is also prohibited.

Using the services of Illevante Cloud LLC to transmit or store on the server any information, data, content, material or works that infringe the copyright, trademarks, service marks, patents, trade secrets or any other intellectual property rights of any person or entity is prohibited.

Using the services of Illevante Cloud LLC for the deliberate distribution of software, computer code, files or programs that cause, or attempt to cause, harm, harassment or annoyance to persons, entities, data and/or computer systems is prohibited.

Using the services of Illevante Cloud LLC to harm minors in any way, or to transmit or store any pornographic material on the server, is strictly prohibited. The customer undertakes to apply and enforce these provisions against all its users, and undertakes to provide its own email addresses for reporting violations (abuse/postmaster) and to respond promptly and appropriately to all messages received at these addresses. Illevante Cloud LLC will comply with all orders and obligations issued by any court or government authority. Please consult a lawyer if you are unsure of the legal status of any of your activities.
